To ensure the safety of our guests and to comply with insurance requirements, certain waivers and release agreements must be completed prior to participation in activities or overnight stays.
By entering the property or participating in any activities, you acknowledge that you have read, understand, and agree to the applicable waivers and policies outlined below.
1. Master Liability Waiver (Required for All Guests)
All overnight guests, day visitors, and individuals entering the property must agree to the Master Liability Waiver.
Camping, creek access, and outdoor recreation involve inherent risks, including but not limited to:
• Uneven or natural terrain
• Water hazards and creek conditions
• Wildlife and insects
• Weather and environmental conditions
• Alcohol-related incidents
• Use of equipment and recreational activities
By entering the property, guests acknowledge and voluntarily assume all such risks.
This waiver releases Two Buddies Wiser, LLC from liability for injury, loss, or damage resulting from ordinary negligence, to the fullest extent permitted under the laws of the Kentucky.
All adults (18+) must complete this waiver prior to entry.
Parents or legal guardians must complete the waiver on behalf of any minor.
2. Tubing / Float Waiver (Required for Float Participants)
Tubing and creek activities involve additional inherent risks, including but not limited to:
• Strong or changing currents
• Slippery rocks and surfaces
• Variations in water depth
• Physical exertion and fatigue
• Changing weather and water conditions
All participants must complete the Tubing Waiver prior to launch.
Participation is voluntary and at your own risk. No exceptions.
3. Event Waiver (Required for Certain Events)
Certain events may require an additional waiver due to factors including:
• Live entertainment
• Alcohol service
• Large crowds
• Temporary structures, equipment, or event setups
If you are attending a ticketed or designated event, completion of an Event Waiver may be required prior to entry.
4. Pet Agreement Addendum (Required for Guests Bringing Pets)
Guests bringing pets onto the property must complete the Pet Agreement Addendum.
By bringing a pet, guests acknowledge and agree:
• Full responsibility for their animal’s behavior
• Financial responsibility for any injury or damage caused
• Immediate removal of aggressive or disruptive animals upon request
Proof of current vaccinations, including rabies, may be required.
Electronic Agreement & Acknowledgment
All waivers may be completed electronically.
By signing electronically or proceeding with a reservation, check-in, or activity participation, you acknowledge that your agreement constitutes a legally binding electronic signature with the same force and effect as a handwritten signature.
Important Notice
Failure to complete required waivers may result in:
• Denied participation in activities
• Denied check-in
• Removal from property
• No refund
Governing Law & Venue
All waivers and agreements are legally binding and governed by the laws of the Kentucky.
Any disputes arising from participation, use of the property, or these agreements shall be resolved exclusively in the courts of Lewis County, Kentucky.
